We attach great importance to the responsible handling of personal data. We want you to know when and what data is collected through your use of the website www.arbeitsinspektion.gv.at and how this data is used.

Personal Data

We process data that you have provided to us or that we have lawfully received or collected on the basis of your consent. “Personal data” means any information relating to an identified or identifiable natural person. Special categories of personal data (formerly referred to as “sensitive data”) are subject to a higher level of protection.

When you visit the website www.arbeitsinspektion.gv.at, the following information is recorded in log files (server logs):

  • IP address of the person making the request
  • Request details and destination address
  • Name of the requested file and amount of data transferred
  • Date and time of the request
  • Information as to whether the request was successful
  • Request processing time in microseconds
  • User agent used
  • SSL version used
  • Referrer
  • Version of the HTTP protocol used
  • HTTP method

The data is stored for a limited period of six months. This data is used exclusively to monitor system security. No personal analysis or profiling is carried out.

Data is only disclosed if an attack on, or illegal access to, the Federal Ministry’s internet infrastructure is suspected and the data must be forwarded to the competent security authorities for the purposes of clarification or prosecution.

In addition, certain cookies and information that you provide yourself by completing forms may be processed. Data that you provide to us via forms (e.g. reporting and contact forms, newsletter registration) for specific purposes is handled responsibly by our staff on the basis of your consent (Art. 6(1)(a) GDPR) and is not used for any other purposes. It is entirely up to you whether you wish to provide this data.

Legal Basis for the Processing of Your Data

The legal basis for the processing of your data is set out in Art. 6(1) of the General Data Protection Regulation (GDPR), depending on whether:

  • you have consented to the processing of your data (Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR; for example, when subscribing to a newsletter or completing a contact form);
  • the processing is necessary for compliance with a legal obligation (Art. 6(1)(c) GDPR);
  • the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in us (Art. 6(1)(e) GDPR).

You may withdraw your consent at any time.

Data Processing

Labour Inspectorate Website

The purpose of data processing via the Labour Inspectorate website is to provide information about the Ministry’s area of responsibility (within the meaning of the Federal Ministries Act 1986, Part 1 of the Annex to Section 2, matters relating to providing information about the Ministry’s area of responsibility, including relations with the press, radio and television).

By using the website or the content provided by the Labour Inspectorate, you, as a user, consent to the processing of your data as described in this Privacy Notice.

Data recorded when accessing the online services is only disclosed to third parties where we are legally obliged to do so or where this is required by court order, or where disclosure is necessary for law enforcement or criminal prosecution in the event of attacks on the internet infrastructure.

Statistics and Analysis

The open-source tool Matomo is used to analyse user behaviour on the website www.arbeitsinspektion.gv.at. The analysis is based on server logs, but is carried out exclusively on an anonymous basis. The IP address contained in the server logs is anonymised before the analysis is performed. This ensures that no personal data is available in the analysis system. Accordingly, no personal data is stored for statistical analysis.

Cookies

Cookies are small text files stored on the computer of the person making the request in order to recognise the user. The information contained in cookies is used for session management, server load balancing, analytical purposes (Matomo cookies), enhancing the security of applications, and improving customisation and usability. This enables a high level of user-friendliness of the website to be ensured. No personal data is stored in cookies.

You can prevent the use of cookies by changing the relevant settings in your browser software. If you do not allow cookies, you can generally still use our website.

Profiling

No personal user profiles are created.

Links to Websites of Other Providers

Our online services contain links to websites operated by other providers. We have no influence over whether these providers comply with data protection regulations.

Social Media

The Labour Inspectorate uses social media and services (Facebook, Instagram, LinkedIn, YouTube) for the purpose of providing information about our activities. We only publish personal data on social media with the consent of the persons concerned.

We take the current debate surrounding data protection on social networks very seriously. At present, it has not been conclusively clarified from a legal perspective whether and to what extent all of the networks mentioned provide their services in compliance with European data protection regulations.

We therefore expressly point out that the services Facebook, Instagram and LinkedIn used by the Labour Inspectorate process their users’ data (e.g. personal information, IP address) in accordance with their respective data use policies and use such data for business purposes.

The Labour Inspectorate has no influence over the collection of data or its further use by the aforementioned social networks. Please use the information provided by the Labour Inspectorate on social media responsibly and only enter your personal data on the networks used by the Labour Inspectorate after reading the privacy notice of the respective provider.

Who Receives Your Data?

Within the Labour Inspectorate, those departments and staff members receive your data who require it to fulfil contractual, legal and other obligations. Furthermore, your data is disclosed to the processors commissioned by us, who are obliged to treat the data confidentially and may only process such data to the extent necessary to provide the services contractually agreed. Statutory provisions may require the data to be transmitted to other public authorities.

Please note that, pursuant to Art. 22a of the Federal Constitutional Law (B-VG) and the provisions of the Federal Act on Access to Information (Information Freedom Act – IFG), Federal Law Gazette I No. 5/2024, the Federal Ministry for Labour, Social Affairs, Health, Care and Consumer Protection may be obliged to proactively publish personal data on the data.gv.at platform or, on a case-by-case basis, to provide it to persons requesting access to information.

As a general rule, your data will only be disclosed if you have consented to its disclosure or if disclosure is required by law.

What Rights Do You Have?

You have the rights provided for under the General Data Protection Regulation and the Austrian Data Protection Act (DSG). In principle, this means that you have the right of access, the right to rectification, the right to erasure, the right to restriction of processing, the right to object and the right to data portability. You may withdraw any consent you have given in writing at any time with effect for the future.

Individual rights may be restricted pursuant to Article 23 GDPR. In some cases, statutory provisions – such as retention, documentation or limitation periods – may prevent data subjects from exercising their rights (for example, a statutory retention period may take precedence over the right to erasure).

Pursuant to Section 24 DSG, you have the right to lodge a complaint with the Austrian Data Protection Authority (dsb@dsb.gv.at; Barichgasse 40–42, 1030 Vienna) if you believe that the processing of your personal data infringes the GDPR or Section 1 DSG or Sections 7-13 DSG.
